Key points in contract between Mainland China’s tour operators organizing tours for mainland residents to Macao and Macao’s ground receiving agents

1. Clarify the denomination, business permits and contact information of the two sides.
2. Clarify relevant information about the tour leader of the organizing tour operator and the tour guide of the ground receiving agent.
3. Both sides should confirm specific arrangements of the tour including meals, accommodation, transport, sightseeing, shopping and entertainment, in particular, shopping locations, number of times and duration of shopping in the Macao Special Administrative Region should be clearly stated.
4. In the tour fee, items included, payment amount, date and way of payment should be clearly stated. If there are optional activities subject to additional payment, the content and price must be specified.
5. Clarify the responsibility and obligations of the organizing tour operator and the tour leader.
  a) The organizing tour operator must be authorized to organize outbound tourist activities and must comply with the "Regulations of Travel Agencies";
  b) The tour leader must possess the outbound tour leader qualifications and must comply with the "Measures for the Administration of Professional Tour Leader";
  c) The organizing tour operator cannot use a price below the cost of reception to solicit customers;
  d) Without prior consent of customers, the organizing tour operator cannot transfer their customers for other travel agencies to organize and receive;
  e) Ensure the legitimate rights of tourists and prohibit initiatives to force tourists to shop, if this kind of matter happens, the leader has the obligation to inform immediately.
6. Clarify the responsibility and obligations of the ground receiving agent and the tour guide.
  a) The ground receiving agent must hold a license issued by the Macao Government Tourism Office;
  b) The ground receiving agent cannot quote a price below the cost of reception to organizing tour operators in Mainland China and undertake tour with such price;
  c) The ground receiving agent cannot request tour guide to accompany groups who do not pay or pay a price below the cost of reception and cannot ask the tour guide to meet the reception costs;
  d) The tour guide assigned to receive the tour group must possess the tour guide card issued by the Macao Government Tourism Office;
  e) During the process of receiving the tour group, the ground receiving agent and the assigned tour guide must fully comply with the Decree-Law No. 48/98/M, of November 3, as amended by the Administrative Regulation No.42/2004 and other relevant regulations of the Macao Special Administrative Region;
  f) When tourists arrived to the Macao Special Administrative Region, the tour guide should immediately provide them with a travel itinerary conformed to the above mentioned law;
  g) The ground receiving agent and the assigned tour guide should not deceive or force tourists to shop, or force them to participate in optional activities at their own expenses.
